The terms and conditions contained in this document (“Agreement’) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“user” or “you”) and VIP Publishing Srls and its affiliates (collectively, “VIPP” or ‘we” or ‘us” or ‘our), concerning your access to and use of the www.vipstraightline.com website as well as any other media form, media channel, mobile website or mobile application related or connected thereto (collectively. the “Website”).
Accordingly, those persons who choose to access the Website or to be involved in the services provided by VIPP from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable. All users who are minors in the jurisdiction in which they reside (generally under the age of 18) are not permitted to register for the website or use the VIPP services.
YOU ACCEPT AND AGREE TO BE BOUND BY THIS AGREEMENT BY ACKNOWLEDGING SUCH ACCEPTANCE DURING THE REGISTRATION PROCESS (IF APPLICABLE) AND ALSO BY CONTINUING TO USE THE SERVICE. IF YOU DO NOT AGREE TO ABIDE BY THIS AGREEMENT, OR TO MODIFICATIONS THAT VIPP MAY MAKE TO THIS AGREEMENT IN THE FUTURE. DO NOT USE OR ACCESS OR CONTINUE TO USE OR ACCESS THE VIPP SERVICES OR THE WEBSITE.
1. Nature of Business
VIPP offers the following services: training, coaching and mentoring activity, focused on management skills, soft skills, personal branding and career strategy. The services are provided through webinars (live or pre-recorded), online courses (pre-recorded), 1:1 sessions (in video or in person) or other (books, e-books, other forms of publications).
While we make every effort to ensure that we accurately represent all the products and services that we offer and their potential for income, it should be noted that earnings and income statements made by VIPP and its advertisers / sponsors are estimates only of what we think you can possibly earn. There is no guarantee that you will make these levels of income and you accept the risk that the earnings and income statements differ by individual.
2. Payments
Except when specifically mentioned, all the above mentioned services are on a fee basis, which is specified on our Website or on any other means that we use for advertising (among other emails, instant messaging and web marketing tools), and which include sales taxes where applicable.
By registering to our services, you agree to pay the related price exclusively by traceable means of payment, and primarily online payment through PayPal/Stripe or other certified payment platforms.
3. Contribution License
By posting contributions to any part of the Website or any platform through which VIPP publishes the training material, or making your contributions accessible to the Website by linking your account to any of your social network accounts, you automatically grant, and you represent and warrant that you have the right to grant, to VIPP an unrestricted, unconditional, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide right and license to host, use, copy, reproduce, disclose, sell, resell, publish, broadcast, archive, store, cache, publicly perform, publicly display, reformat, translate, transmit, excerpt (in whole or in part) and distribute such Contributions (including, without limitation, your image and voice) for any purpose, commercial, advertising, or otherwise.
The use and distribution may occur in any media formats and through any media channels. Such use and distribution license will apply to any form, media, or technology now known or hereafter developed, and includes our use of your name, VIPP name, and franchise name, as applicable, and any of the trademarks, service marks, trade names and logos, personal and commercial images you provide. VIPP does not assert any ownership over your Contributions: rather, as between us and you, subject to the rights granted to us in this Agreement, you retain full ownership of all of your Contributions and any intellectual property rights or other proprietary rights associated with your Contributions.
VIPP has the right, in our sole and absolute discretion, to (i) edit, redact or otherwise change any Contributions, (ii) re-categorize any Contributions to place them in more appropriate locations or (iii) pre-screen or delete any Contributions that are determined to be inappropriate or otherwise in violation of this Agreement.
4. Refund Policy
VIPP is very attentive to customers’ success and generally applies refunds of the price that the customers have paid to access to VIPP services, when the customers declare that they are not satisfied with our services.
Where applicable, the refund policy of a specific service is declared explicitly by VIPP at the moment of the purchase. Moreover, it can be limited in the amount and in time, and it can be subject to specific circumstances that you agree to demonstrate, for your request of refund to be deemed acceptable by us.
In case a “100% Money Back Guarantee” refund is applicable on a specific service, VIPP will refund in full the amount paid by you for the purchase of that service, subject to you sending a request by email to
vip@vipstraightline.com, within the deadline indicated at the moment of the purchase (e.g. “7 days Money Back Guarantee”, or “30 days Money Back Guarantee”, …). If your request respects the deadline, VIPP will process a full refund without requiring any explanation, except for a non-mandatory request to fill-in a satisfaction questionnaire.
If a “100% Money Back Guarantee” refund is applicable on a specific service, which you have purchased by instalment, your ability to receive a 100% refund is limited to the amounts that you have paid within the period of guarantee. For example, if a 30-day Money Back Guarantee applies on a purchase where you have paid by installment, you can ask for the Money Back Guarantee to apply only on the installments that you paid during the previous 30 days, while you will not be eligible for a refund of those installments paid before the 30 days period.
It should be noted that for services that require the use of live technology (including but not limited to webinars, 1:1 meetings at distance) and in the event there is a technical issue that will impact the performance of the service, VIPP will try to remedy the situation by re-organizing at a later date for a maximum of two additional attempts, after which regardless of the applicable refund policy, you have the ability to ask for a full refund.
5. Prohibited Activities
You may not access or use the website for any other purpose other than that for which VIPP makes it available. Prohibited activity includes, but is not limited to:
A. Attempting to bypass any measures of the website designed to prevent or restrict access to the website, or any portion of the website.
B. Attempting to impersonate another user or person or using the username of another user.
C. Sharing any of the data obtained through our services to any 3rd parties.
D. Criminal or tortuous activity.
E. Deciphering, decompiling, disassembling or reverse engineering any of the software comprising or in any way making up a part of the website.
F. Deleting the copyright or other proprietary rights notice from any website content.
6. Intellectual Property Rights
The content on the website (“VIPP Content”) and the trademarks, service marks and logos contained therein (“Marks”) are owned by or licensed to VIPP and are subject to copyright and other intellectual property rights. VIPP Content includes, without limitation, all training, coaching and mentoring activity, focused on management skills, soft skills, personal branding and career strategy.
7. Your Privacy
We are very careful about the protection of your personal data, which we collect, use and share, in the frame of your use of our Website and for the purpose of providing you with the services that you request to us.
8. Terms and Termination
This Agreement shall remain in full force and effect while you use the website or are otherwise a user or member of the website, as applicable. You may terminate your use or participation at any time, for any reason, by following the instructions for terminating user accounts in your account settings, if available, or by contacting us.
WITHOUT LIMITING ANY OTHER PROVISION OF THIS AGREEMENT, VIPP RESERVES THE RIGHT TO, IN VIPP’S SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE WEBSITE AND SERVICES, TO ANY PERSON FOR ANY REASON OR FOR NO REASON AT ALL, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENTATION, WARRANTY OR COVENANT CONTAINED IN THIS AGREEMENT, OR OF ANY APPLICABLE LAW OR REGULATION.
